General Terms and Conditions
At Not Your Mother Agency, registered as NYMA Amsterdam ("NYMA Amsterdam"), the well-being of our talent is our top priority. These General Terms and Conditions ("Terms") govern the relationship between customers ("Customer") who contract talent from NYMA Amsterdam ("Model") and NYMA Amsterdam, applying from the time of booking ("Contract Booking") and to all content featuring the Model ("Customer Content").

1. Customer Obligations

1.1 Booking Process
Bookings must be agreed with NYMA Amsterdam; no direct agreements between Customer and Model are allowed without NYMA’s approval.

1.2 Health and Safety
Customer must ensure Model’s safety and well-being, complying with Dutch health and safety laws, providing a private changing area, breaks, food, and water.

1.3 Content Restrictions
No nude, semi-nude, swimwear, or lingerie shots without NYMA Amsterdam’s written approval. Customer Content must not be unflattering, pornographic, or derogatory.

1.4 Behind-the-Scenes
Recording requires NYMA Amsterdam’s written approval and only when Model is fully prepared.

1.5 Weather Conditions
Extreme weather shoots must be pre-notified to NYMA Amsterdam.

1.6 Data Protection
NYMA Amsterdam transfers Model data to Customer, who acts as data processor under GDPR. Customer must: process data only on NYMA’s instructions, ensure security, notify NYMA of breaches within 24 hours, and obtain NYMA’s consent for sub-processors. NYMA processes Customer data to fulfill these Terms per Dutch law.

1.7 Insurance
Customer must maintain insurance covering liabilities to NYMA Amsterdam and Model.

2. Working Hours and Payment

2.1 Workday
Begins at Model’s arrival, includes prep and waiting (excl. 1-hour lunch). Full fee applies even if work ends early.

2.2 Fees

  • Full-Day (Adults): Studio: 9 hrs; Location: 10 hrs (incl. lunch).

  • Half-Day (Adults): Studio: 4 hrs; Amsterdam area: 5 hrs; longer travel: full-day rate.

  • Overtime: 1.5x hourly rate after 9 hrs.

  • Minors: Per Dutch youth labor laws.

2.3 Special Fees

  • Weather/Down Days: 50% day rate.

  • Travel >5 hrs: 50% day rate.

  • Swimwear/Lingerie: Pre-approved, extra fee possible.

2.4 Expenses
Customer covers travel, accommodation, etc., unless agreed otherwise. NYMA travel arrangements: cost + 10% fee.

2.5 Payment
20% agency fee + VAT. Invoices due in 15 days; late payment incurs Dutch statutory interest + €60 fee. New Customers may need advance payment; non-payment allows cancellation.

2.6 Travel Disclaimer
NYMA Amsterdam not liable for flight delays/cancellations.

3. Customer Rights

3.1 Usage
Customer Content use limited to agreed terms; additional use requires NYMA approval.

3.2 Exclusivity
Must be requested and agreed at booking; re-usage excludes exclusivity unless negotiated.

3.3 Artificial Intelligence (AI) Usage
The Customer acknowledges that any images, videos, or other media featuring Models represented by NYMA Amsterdam may not be used for the training, development, or generation of AI models, machine learning algorithms, or synthetic media. Any processing, modification, or replication of the material using AI technology requires explicit prior written consent from NYMA Amsterdam. Unauthorized use of such material for AI-related purposes will be considered a violation of these Terms.

4. Model and Agency Rights

4.1 Promotion
NYMA Amsterdam and Model may use Customer Content for promotion across all media.

5. Cancellation and Complaints

5.1 Customer Cancellation

  • 48 hrs: Free; 24–48 hrs: 50% fee; <24 hrs: Full fee.

  • 3+ day bookings: >72 hrs: Free; 48–72 hrs: 50%; <48 hrs: Full fee.

5.2 Agency Cancellation
NYMA Amsterdam will seek a substitute if Model is canceled.

5.3 Force Majeure
No liability for events beyond control (e.g., pandemics, strikes) per Dutch law.

5.4 Complaints
Must be reported on booking day; NYMA not liable for Model conduct or losses.

6. Breach of Terms

6.1 Indemnity
Customer indemnifies NYMA Amsterdam for breaches, including legal fees.

6.2 Liability
No consequential damages unless Dutch law mandates otherwise.

7. Confidentiality

No disclosure of booking or content details, except to employees, for legal compliance, or to enforce rights.

8. Jurisdiction

Governed by Dutch law; disputes resolved by Amsterdam District Court.
